The 46 Foundation SMS/MMS Communications

These Terms & Conditions govern SMS/MMS communications provided by The 46 Foundation, operated by York County Emergency Services Foundation, Inc.
Program Description
The 46 Foundation uses SMS/MMS for low-volume communications with individuals who interact with the organization. Messages may include responses to inquiries, customer or participant support, program and event information, scheduling and registration updates, volunteer coordination, operational notifications, and other communications requested or reasonably expected by recipients.
The Foundation may also operate The 46 Foundation – Alerts, an automated monitoring and notification service that may provide operational status changes, detected events, monitoring alerts, system notifications, or other information generated by monitored systems.
Consent to Receive Messages
SMS/MMS messages are sent to individuals who have provided appropriate consent or who have initiated an SMS/MMS conversation with The 46 Foundation.
Consent may be provided verbally, through an inbound SMS/MMS message, or through other consent methods offered by the Foundation.
When an individual initiates an SMS/MMS conversation with The 46 Foundation, the Foundation may respond with messages related to that inquiry or interaction. Initiating a conversation does not constitute consent to receive unrelated marketing or promotional messages.
Consent to receive SMS/MMS messages is not a condition of conducting business with The 46 Foundation.
Message Frequency and Charges
Message frequency varies depending on the recipient's interaction with the Foundation, requested services, program or event activity, and communication preferences.
Message and data rates may apply according to the recipient's wireless service plan.
Opting Out
Reply STOP to any SMS/MMS message to stop receiving messages from the applicable messaging program. After an opt-out request is processed, no further messages covered by that consent will be sent unless the recipient subsequently provides consent to resume messaging.

Delivery
Wireless carriers are not liable for delayed or undelivered messages. Message delivery may be affected by carrier availability, network conditions, equipment or software failures, or other circumstances outside The 46 Foundation's control.
The 46 Foundation – Alerts and Emergency Communications
The 46 Foundation – Alerts is a supplemental monitoring and notification service. It is not a substitute for 911, an official public-safety CAD or dispatch system, an emergency notification system, or direct communications from a public-safety agency.
Messages from The 46 Foundation, including SMS alerts, should not be relied upon as the sole source for emergency response, dispatch, or other life-safety decisions.
Privacy
Information associated with SMS/MMS participation is handled in accordance with The 46 Foundation's Privacy Policy available on the Foundation's website.
Mobile telephone numbers, SMS opt-in information, and SMS consent information are not sold, rented, or shared with third parties or affiliates for their own marketing or promotional purposes.
Changes to These Terms
These Terms may be updated periodically. The current version and effective date will be maintained on this page.
